Do You Have A Dispute?
|
Are you faced with an unhappy
situation that you just want resolved? Has it gotten to the point
that the dispute is interfering with your regular practice or
personal affairs? Are both sides thinking there is no hope to
avoid the time, energy and cost of litigation? THINK AGAIN! If you
want to maintain a cordial relationship with the other side after
the dispute, litigation is probably not the way to go! If you want
to save time and money, again, litigation is probably not for you!
The only way to get a solid resolution and keep a good
relationship is to have an equitable tailored settlement. And
that’s where mediation comes in.
What is Mediation?
Mediation is a process in which trained skilled neutral mediators
help parties in a dispute to reach a mutually acceptable
resolution to their differences. The goal of mediation is to find
areas of agreement and create solutions devised by the parties and
neutral. The skill of the mediators, their knowledge of a
particular business and industry is critical to getting effective
help.
What are the
Advantages of Mediation?
Mediation is speedy, less adversarial and a less hostile process than
litigation. It is also less expensive. It allows the parties to be directly
involved in the effort to negotiate solutions. It helps to move the parties
into the cooperative arena of positive, constructive agreement. Mediation
has proven to be a highly effective and successful form of dispute
resolution.
Here's how it
works.
One or all parties secure a One Hour Consultation by telephone or
in person. If written materials are important to the dispute they
are submitted ahead of the consultation. The consultation is $495
and includes an organizer sent ahead of the consultation. The
organizer
is used to briefly document dispute aspects. Document review time
is provided pro rata. As a result of the consultation and the
discussion either the matter will be scheduled for a Mediation
Conference or no further action will be taken.

Moving on to the mediation -
Initial Review. Following the consultation, additional information
or documents may be requested on financial, practice, personnel,
valuation or other issues identified in the consultation session.
A separate questionnaire for each party will be prepared and sent.
After we receive the completed questionnaires, each doctor
involved is called to clarify any answers and to schedule a time
for the mediation. The Initial Review is $3495 and includes
reviewing the questionnaire and materials and conference call.
The Mediation Conference. The Conference is a 1 - 4 hour
meeting with the doctors (amount of time depends on the
complexity of the dispute being mediated) during which the
parties go through a step by step interview and attempted
resolution process designed to resolve the dispute. The
mediation conference is $685 per hour.
After the Mediation Conference.
A brief bullet point concluding memo will be prepared by the
mediators following the mediation. The preparation is $295 per
hour. The memo will summarize the conference and will outline,
without being binding, any dispute settlement and what each party
has agreed to do. This memo is sent to the doctors. If requested
we will also prepare a timeline for any suggested post-resolution
process.
